Delhi High Court Defers Sentence, Orders Bail for Medha Patkar in Defamation Case

New Delhi, India – In a significant development, the Delhi High Court on Friday deferred the sentence awarded to renowned social activist Medha Patkar and ordered her immediate release on bail. Patkar had been arrested earlier in the day following the issuance of a Non-Bailable Warrant (NBW) by the Saket Court for non-compliance with a prior order.

Patkar’s arrest stems from her conviction in a defamation case filed by Delhi’s incumbent Lieutenant Governor (LG) VK Saxena in 2001. The appellate court had sentenced her to probation for good conduct for one year and mandated the payment of Rs 1 lakh in compensation to Saxena. However, this order has been challenged before the High Court.

Interim Relief Granted

Justice Shalinder Kaur, presiding over the matter, considered submissions from both parties and directed that Patkar be released on bail as interim relief. The court has deferred her sentence until 20 May 2025, the next scheduled hearing date.

In her ruling, Justice Kaur stated, “As contentious issues have been raised on behalf of the parties with respect to the suspension of sentence, and that the learned Senior Counsel submits that the petitioner has been taken in custody in execution of the NBW, therefore, in these circumstances, by way of an interim means, the petitioner be released on bail on furnishing a personal bond in the sum of Rs 25,000 with one surety in the like amount to the satisfaction of the learned ASJ/Link ASJ/CMM/Duty Magistrate.”

Legal Representation and Arguments

Patkar was represented by Senior Advocate Sanjay Parikh and Advocate Abhimanyu Shreshth, who argued that the activist had complied with the law in its entirety. Conversely, Advocate Gajinder Kumar, representing VK Saxena, sought additional time to file a response to Patkar’s petition. The High Court has given Saxena two weeks to respond.

Case Background

Medha Patkar’s legal battle has been long and complex. On 24 May 2024, a Magistrate Court convicted her of defamation and sentenced her to three months imprisonment while ordering her to pay Rs 10 lakh as compensation to VK Saxena. Patkar subsequently appealed the decision before the appellate (Sessions) court, which on 1 July 2024 granted her bail to challenge the order.

Following her appeal, the appellate court ruled on 8 April 2025, sentencing her to probation for good conduct for one year and directing the payment of Rs 1 lakh in compensation. Patkar was required to appear before the court on 23 April 2025 to furnish a probation bond and deposit the compensation amount. However, her failure to comply with this directive led to the issuance of the NBW and her subsequent arrest by Delhi Police.

Saket Court’s Proceedings

Patkar was produced before the Saket Court shortly after her arrest. The court dismissed her application for deferment, resulting in the issuance of the NBW. She was released after furnishing a bond of Rs 25,000 and submitting the compensation amount of Rs 1 lakh.

High Court’s Intervention

On 22 April 2025, Patkar had approached the High Court seeking deferment of the sentence, only to be redirected to the appellate court at Saket. Following the appellate court’s rejection of her application, the High Court provided interim relief on Friday, allowing her release on bail.

Next Steps

The case now awaits further proceedings on 20 May 2025, where the High Court is expected to address the contentious issues raised by Patkar’s counsel and Saxena’s legal team. The resolution of this high-profile legal matter could set a precedent for similar defamation cases in India.
